so here's all the legal stuff.
1a. To enter:
Participate on the show by calling-in during the live program (1-800-899-INTO)
or send an email to participate on the show, or complete the “Submit
& Win” Survey.
1b. For special
periodic contests (like the Computer System GiveAways), complete
the separate form and the limit is ONE entry per household.
Additional entries may void all of your entries. Final determination
of our winner(s) is based on the entry being legitimate and complying
with our rules.
2. No purchase
or payment is necessary to enter. Limit one entry per person, per
household per 90 day period. All entrants will be eligible to win
one item, given away in a random drawing of all eligible registrants.
The odds of winning depend on the number of eligible entries received
and submitted in accordance with the rules.
3. Open to legal
residents of the United States, except employees and their immediate
families of Advanced Radio Network, and their affiliates, subsidiaries,
and its advertising and promotion agencies. All federal, state,
and local laws and regulations apply. Void where prohibited or restricted
by law. All federal, state, and local taxes are the sole responsibility
of the winner. A 1099 form may be filed with the IRS for major prize
winners. Winners may be required to submit a signed affidavit certifying
their eligibility. Failure to submit a properly completed affidavit
will result in selection of an alternate winner. In order to participate,
you must have a Java capable browser that can accept cookies.
4. By completing
the Survey or submitting an Email that is used on the air, or participating
via an on-air phone call, for the “Into Tomorrow” Listener
Giveaways, the registrant agrees to abide by the terms of these
official rules and agrees to receive the once-a-week TechNewsLetter
Email from the show and agrees that the decisions of ADVANCED RADIO
NETWORK are final and binding on all matters pertaining to the Giveaways.
Any entry that contains inaccurate or false information (i.e. wrong
address or phone or Email) or failure of the Entrant to acknowledge
prize notification in order to verify delivery information within
5 business days, or any prize that is returned as undeliverable,
will result in the Entrant forfeiting that prize. Except where prohibited
by law, each winner consents to the use of their name and entry
in any manner by ADVANCED RADIO NETWORK and its advertising and
promotion agencies without further compensation. Neither ADVANCED
RADIO NETWORK, nor its affiliates, subsidiaries, divisions, or related
companies of either of them are responsible for any damages, taxes,
or expenses that any winner might incur as a result of the Giveaways
or receipt of any prize. All winners accepting prizes agree that
all prizes are awarded on the condition that ADVANCED RADIO NETWORK
and agents, representatives, affiliates, and employees of either
of them will have no liability whatsoever for any injuries, losses,
or damages of any kind resulting from acceptance, possession, or
use of the prizes. Each winner further acknowledges that ADVANCED
RADIO NETWORK is not responsible or liable for any warranty, representation,
or guarantee, express or implied, in fact or in law, relative to
any prize, including but not limited to its quality, mechanical
condition, or fitness. No winner may make any substitutions or transfers
of any prize. ADVANCED RADIO NETWORK reserves the right to substitute
a prize of equal or greater value.
5. Survey and
Email Entries will be deemed made by the authorized account holder
of the email address submitted at the time of entry. Authorized
account holder is deemed to be the natural person who is assigned
to an email address by an Internet access provider, service provider,
or other online organization that is responsible for assigning email
addresses for the domain associated with the submitted email address.
Each potential winner may be requested to provide ADVANCED RADIO
NETWORK with proof that the potential winner is the authorized account
holder of the email address associated with the potentially winning
entry. ADVANCED RADIO NETWORK will have no liability whatsoever
if for any reason the giveaway is not capable of running as planned,
including infection, computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures, or any other causes beyond
the control of ADVANCED RADIO NETWORK. ADVANCED RADIO NETWORK reserves
the right at its sole discretion to disqualify any individual who
corrupts or affects the administration, security, fairness, integrity,
or proper conduct of the giveaway or tampers with the entry process,
and to cancel, terminate, modify, or suspend the giveaway. ADVANCED
RADIO NETWORK assumes no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorized
access to, or alteration of, entries. ADVANCED RADIO NETWORK is
not responsible for any problems or technical malfunction of any
telephone network or lines, computer online systems, servers, or
providers, computer equipment, software, failure of any email or
entry to be received by ADVANCED RADIO NETWORK on account of technical
problems or traffic congestion on the Internet or at any website,
or any combination thereof, including any injury or damage to participants'
or any other person's computer related to or resulting from participation
or downloading any materials in the giveaways.
CAUTION: ANY
ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE
THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL
AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, ADVANCED RADIO
NETWORK RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT
TO THE FULLEST EXTENT PERMITTED BY LAW.
